On the job injuries.

When you have an on-the-job injury or occupational disease, you need an attorney who is experienced in Missouri and Kansas workers compensation law.

Most employers have workers compensation insurance that covers you if you have been injured on the job. You are entitled to compensation in a Missouri workers compensation claim whether you, a fellow worker or your employer was at fault. You are entitled to the following benefits:

bulletTemporary total disability payments
If you are out-of-work your employer should be paying you two-thirds of your average weekly wage subject to a waiting period and state maximum allowances.
bulletMedical expenses
Your medical expenses including doctor bills, physical therapy and prescriptions should be paid. (Generally an employer is permitted to select the doctor.)
bulletPermanent disability
If you have a lasting effect from your injury, you are generally entitled to a lump sum payment for that disability whether it is a partial disability or a total disability.

You should receive temporary total benefits until you reach maximum medical improvement. After you reach maximum medical improvement, you should receive permanent partial or permanent total disability benefits.

Why hire an attorney?

There are two reasons to hire an attorney in workers compensation:

bulletTo make sure you get all benefits in a timely fashion.
You should not have to wait to receive your medical care and temporary total disability payments.
bulletTo get a maximum recovery.
The money you receive for permanent partial disability or permanent total disability will close your case. You will live with the disability the rest of your life. You deserve just compensation.
bulletThere is no fee for an initial consultation and there is no fee if there is no recovery for you.

The insurance company will hire their doctor to give you a rating. Generally doctors hired by insurance companies are conservative in the rating.  You need your own doctor to make sure the rating is done correctly.
